هنوز دكترين قوانين بين المللي و سياست گذاران ،اشغال از طريق سازمانهاي بين المللي بواسطه حكومت ها و دولت ها را پديده سياسي و حقوقي مجزا در نظر مي گيرد.ننگ مرتبط با اشغال دولتي به دو عملياتي تعبير شده كه بوسيله هنجارهاي متفاوت و تاكتيك هاي خود براي تاييد موضوع كنترل براي استانداردهاي مختلف مشروعيت،مديريت مي شوند..اين مقاله دوگانگي و تجزيه اعتقادي همراه با انرا رد كرده،بر ويژگيهاي مشترك وچالش هاي اين اشغال تاكيد مي كند و درباره ارزيابي سياسي و حقوقي مشترك به بحث مي پردازد.از منظر حقوقي دو نوع كار تحت لواي چهارچوب حقوقي مشترك انجام مي شود كسانيكه اين دو نوع را مديريت مي كنند بايد توازن مناسبي ميان قانون بشر دوستانه بين المللي،قانون حقوق بشر بين المللي ،قانون محلي و دستورات يك سازمان بين المللي پيدا كنند..
